1. Acceptance of Terms
By downloading, accessing, or using the QuestSmith mobile application (the "Application"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree, do not use the Application.
2. Eligibility & Account
Access to certain features requires registration and authentication services. You must provide accurate information and are responsible for maintaining the confidentiality of your credentials and all activity under your account.
3. Permitted Use
The Application is provided for personal, non-commercial use. You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of the Application;
- Use the Application to transmit harmful, illegal, or infringing content;
- Interfere with or disrupt servers or networks connected to the Application;
- Use automated means (bots, scrapers) to access the Application without permission.
4. Third-Party Services
The Application integrates third-party services for authentication and related functionality. Your use of such services may be governed by separate terms and privacy policies. The Service Provider is not responsible for third-party content or practices.
5. User Content
If the Application allows you to submit or share content, you retain ownership of your content. You grant the Service Provider a non-exclusive, worldwide, royalty-free license to host, display, and distribute such content within the Application for the purpose of operating and improving the service. You represent that you have all rights necessary to grant this license and that your content does not violate any law or third-party rights.
6. Intellectual Property
All rights, title, and interest in and to the Application (including software, design, text, graphics, logos, and trademarks) are owned by the Service Provider or its licensors and are protected by intellectual property laws. No rights are granted to you except as expressly set forth in these Terms.
7. Termination
The Service Provider may suspend or terminate your access to the Application at any time, with or without notice, for conduct that it believes violates these Terms or is harmful to other users, the Service Provider, or third parties. Upon termination, your right to use the Application will immediately cease.
8. Disclaimers
The Application is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service Provider does not warrant that the Application will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Application, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Service Provider and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Application, your violation of these Terms, or your infringement of any third-party right.
11. Changes to the Terms
The Service Provider may revise these Terms from time to time. Material changes will be indicated by updating the Effective Date above. Your continued use of the Application after such changes constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where 911 Vault Corp. is organized and operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
14. Subscriptions & Billing (Apple App Store)
Subscriptions are offered on an auto-renewable basis through the Apple App Store.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You may manage or cancel your subscription at any time by going to your Apple ID account settings after purchase. Deleting the Application does not cancel your subscription.
- Prices may vary by location and are subject to change in accordance with Apple's policies.
